Terms of Service

Welcome to PerfectLine Gym & Fitness ("the App"). By accessing or using the App, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By registering for, accessing, or using the PerfectLine Gym & Fitness mobile application, you agree to comply with and be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. About the Service

PerfectLine Gym & Fitness is a mobile application that provides gym members with:

• Digital membership management
• Barcode-based gym check-in system
• Transaction history viewing
• Account balance tracking
• Profile management
• Access to gym house rules and information

The App is operated by IT Centar ("we," "us," or "our"), located at Cara Dušana 90, Niš, Serbia.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 17 years old to use this App. By registering, you represent and warrant that you meet this age requirement.

3.2 Account Creation

To use the App, you must:

• Provide accurate and complete registration information (name, email address, password)
• Verify your email address
• Maintain the security of your account credentials
• Have an active gym membership with Perfect Line Gym

3.3 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

4. Acceptable Use

4.1 Permitted Use

You may use the App only for lawful purposes and in accordance with these Terms. You agree to use the App solely for managing your gym membership and accessing gym facilities.

4.2 Prohibited Conduct

You agree NOT to:

• Share your account credentials or digital barcode with others
• Screenshot or share your check-in barcode to enable unauthorized gym access
• Attempt to circumvent the barcode refresh security mechanism
• Use the App to violate any applicable laws or regulations
• Attempt to gain unauthorized access to any part of the App or its systems
• Interfere with or disrupt the App's functionality or servers
• Use automated tools (bots, scripts) to access the App
• Reverse engineer, decompile, or disassemble the App
• Transmit any viruses, malware, or harmful code
• Impersonate another person or entity
• Provide false or misleading information during registration

5. Gym Membership

5.1 Membership Requirement

The App requires an active gym membership with Perfect Line Gym. The App is a digital tool to manage your membership and does not grant membership rights on its own.

5.2 Membership Fees

• Membership fees are determined by Perfect Line Gym and are subject to change
• The App displays your membership status, fees, and transaction history for informational purposes only
• Payment for memberships is handled outside the App (at gym reception or other designated methods)
• The App does not process payments or handle financial transactions

5.3 Membership Cancellation

To cancel your gym membership, please contact Perfect Line Gym directly at perfectlinenis@gmail.com. Deleting your App account does not automatically cancel your gym membership.

6. Digital Barcode Check-In System

6.1 Barcode Functionality

The App generates a unique, time-limited barcode for gym check-in purposes. This barcode:

• Refreshes automatically every 55 seconds
• Is unique to your account
• Should not be shared with others
• Must be scanned in person at gym entrance

6.2 Security Measures

The time-limited barcode system is designed to prevent unauthorized access. Screenshots of barcodes will not work after the refresh period expires. Any attempt to circumvent this security feature is strictly prohibited.

7. User Content and Data

7.1 Your Information

You may provide optional profile information such as phone number, birthdate, gender, and location. You represent and warrant that any information you provide is accurate and current.

7.2 No User-Generated Content

The App does not include features for user-generated content, social interaction, or communication between users. You cannot post, share, or upload content visible to other users.

8. Intellectual Property

8.1 Our Rights

The App, including its design, features, text, graphics, code, and all intellectual property rights therein, is owned by IT Centar or its licensors. All rights are reserved.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8.3 Trademarks

"PerfectLine," the PerfectLine logo, and related marks are trademarks of IT Centar. You may not use these marks without our prior written permission.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is described in detail in our Privacy Policy, which is incorporated into these Terms by reference.

Key points:

• We collect minimal data necessary for membership management
• We do not share your data with third parties
• We do not use analytics, tracking, or advertising services
• You can delete your account and all associated data at any time

10. Account Deletion

You may delete your account at any time from within the App (Settings > Delete Account). Upon deletion:

• All your personal information will be permanently removed from our servers within 30 days
• This includes your profile information, transaction history, and membership data
• Account deletion is irreversible and cannot be undone
• You will lose access to the App immediately
• This does NOT cancel your gym membership (see Section 5.3)

11. Disclaimers and Limitations of Liability

11.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 No Warranty

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from the App will be accurate or reliable
• Any errors in the App will be corrected
• The App will be compatible with all devices or operating systems

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IT CENTAR, ITS DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

11.4 Maximum Liability

In no event shall our total liability to you for all claims exceed the amount you paid for your gym membership in the three months preceding the claim.

11.5 Third-Party Services

The App relies on third-party infrastructure (hosting, APIs). We are not responsible for any failures, interruptions, or issues caused by third-party service providers.

12. Indemnification

You agree to indemnify, defend, and hold harmless IT Centar, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

13. Modifications to the App and Terms

13.1 Changes to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, for any reason.

13.2 Changes to Terms

We may update these Terms from time to time. Changes will be effective upon posting to the App or our website. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. We will notify you of material changes via email or in-app notification.

14. Termination

14.1 Termination by You

You may terminate your account at any time by using the account deletion feature in the App.

14.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the App at any time, without prior notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Prolonged inactivity
• Expiration or cancellation of your gym membership
• Request from law enforcement or government authorities

14.3 Effect of Termination

Upon termination, your right to use the App will immediately cease, and we may delete your account data in accordance with our Privacy Policy.

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions.

15.2 Jurisdiction

Any disputes arising out of or related to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Niš, Serbia.

15.3 Informal Resolution

Before pursuing formal legal action, we encourage you to contact us at office@itcentar.rs to attempt to resolve the dispute informally.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and IT Centar regarding the App and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

16.5 Language

These Terms are provided in English and Serbian. In case of any discrepancy, the Serbian version shall prevail.
